What's Included in the Background Check

Your Indiana mortgage license background check includes three main components, all conducted through NMLS:

Credit Check: The DFI reviews your credit history to evaluate financial responsibility. They look at your overall credit management, including payment history and current debts. While a less-than-perfect credit score doesn't automatically disqualify you, the DFI considers bankruptcies in the last 10 years, current outstanding judgments or tax liens, foreclosures in the last 3 years, and patterns of seriously delinquent accounts in the last 3 years. These financial issues don't necessarily disqualify you, but they require explanation and review.

Criminal Background Check: You'll complete an FBI fingerprint-based criminal background check through NMLS. This check searches both federal databases and Indiana's criminal history records. The fingerprinting process is handled electronically through approved vendors, and your prints are sent directly to the FBI for processing.

NMLS Record Check: The DFI reviews your NMLS record for any previous licensing issues in other states. This includes checking for past license revocations, suspensions, or disciplinary actions. Indiana-Specific Background Check Requirements

Indiana doesn't require additional background checks beyond the federal FBI check. The Indiana DFI processes your application and reviews the FBI results along with your credit report. Indiana uses the standard NMLS fingerprinting process, so there's no need for separate state fingerprinting. The DFI reviews your complete application package, including background check results, before making a licensing decision.

Disqualifying Factors

Understanding what can prevent you from getting licensed helps you assess your eligibility before applying:

Criminal History: The SAFE Act establishes permanent disqualifications for certain crimes. Any felony conviction involving fraud, dishonesty, breach of trust, or money laundering permanently bars you from licensure unless the conviction has been pardoned or expunged. Any other felony conviction in the 7 years immediately preceding your application will prevent licensure unless pardoned or expunged. If your conviction is more than 7 years old and doesn't involve financial crimes, you may be eligible.

Financial Issues: Credit problems don't automatically disqualify you, but they require review. Bankruptcies within the last 10 years, current outstanding judgments or tax liens, foreclosures within the last 3 years, and patterns of seriously delinquent accounts in the last 3 years will all be considered. The DFI evaluates these issues on a case-by-case basis. You'll have the opportunity to provide explanations and demonstrate how you've addressed past financial problems.

Previous Licensing Issues: If you've had a mortgage license revoked in any state, you cannot obtain an Indiana license unless that revocation has been formally vacated. Current license suspensions or pending disciplinary actions in other states will also impact your Indiana application. The DFI reviews your complete licensing history across all states.

Indiana-Specific Disqualifiers: Beyond federal requirements, Indiana law prohibits licensing anyone who has knowingly made material misrepresentations in their application or who would be obtaining the license for someone else who doesn't qualify. If the DFI discovers facts that would have prevented licensure had they been known earlier, your license can be denied or revoked.

How Long Does the Background Check Take?

Background check processing typically takes 3 to 6 weeks. The FBI fingerprint check usually processes within 2 to 3 weeks, but can take longer during high-volume periods. The Indiana DFI then reviews your complete application, including background check results, which adds another 1 to 3 weeks. Factors that may delay processing include fingerprint quality issues requiring resubmission, complex credit histories requiring additional review, previous licensing issues in other states, and incomplete application information.

What If You Have Issues in Your Background?

Not all background issues automatically disqualify you from licensure. Full disclosure is required on your NMLS application. You must answer all disclosure questions honestly and completely. Failing to disclose information is itself grounds for denial and can result in permanent disqualification.

If you have issues in your background, you'll need to provide detailed explanation letters. Describe the circumstances surrounding any criminal convictions, financial problems, or licensing issues. Explain what you've learned and what steps you've taken to address these issues. Include supporting documentation like court records, payment plans, or financial rehabilitation evidence.

The Indiana DFI reviews each situation individually. The review process considers the nature and severity of the issue, how long ago it occurred, and evidence of rehabilitation or changed circumstances. Background Check Costs

The background check involves several fees paid through NMLS:

  • FBI criminal background check: $36.25

  • Credit report: $15

  • Total background check cost: $51.25

These fees are in addition to other licensing costs like NMLS processing fees, state license fees, education, and examination fees. All fees are non-refundable, even if your application is denied.

Next Steps

Once you pass your background check and all other requirements are met, the Indiana DFI will approve your license. You'll receive notification through your NMLS account when your license is approved and active. At that point, you can begin originating loans under your sponsoring employer's supervision.
